I was driving along highway 6 in the right lane with cruise control set to 70, and I saw a trooper pull a u-turn as soon as he'd passed by me going the opposite direction. Immediately, I knew he was gunning for me, but I just kept my bearing and waited for the inevitable.

A few minutes passed, and I now had a trooper tailgating me in the right lane. This continued for about 5 miles until he decided it was time to turn on his lights. I immediately moved over onto the shoulder, and turned off my car after rolling down my window. He walks up to my car, and asked me if I knew why I'd been pulled over today. I dutifully responded no, at which point he pondered for a moment and responded it was because I had no front plate. After that he asked what was in my kennel in the passenger seat, and I pointed out it was my lovely cat Frank. He went to run my info, and after that was when things got interesting.

After coming back to my car, he began to probe into what else I might have in my car. "Do you have anything illegal in your car today?"

"No, sir."

"What else do you have in your vehicle?"

"Well, I've got my cat up front, and my backpack with my clothes in the trunk."

"Are you sure you don't have anything illegal in your car today? I'd like to take a look through—"

At this point I cut him off. I didn't have anything fun in my car at all, and I wasn't about to authorize an illegal search of my vehicle. "I will not consent to the search of my vehicle." I said, as I looked him dead in the eyes. After that, he was taken aback and said he had to go run some more information in his patrol car. I assume he was looking for an existing warrant, or something absurd like that. He came back a few minutes later, and asked me to step out of my car so we could talk off the side of the road. The request made sense, but that didn't prevent my heart from going into overdrive.

I stepped out, and went to go talk with him in front of his squad car, presumably in view of his dashcam. He had a few more probing questions for me (Where are you going, are you in school, etc), and then finally bit the bullet and dropped this line-

"So if you have nothing illegal in your car, why wouldn't you consent to a search?"

"Personally, Officer, I find it to be a constitutional issue. If you had a search warrant or probable cause, you wouldn't need my permission to search my vehicle, and I'd be happy to let you do so. Since you have neither, I'd really like to get back on the road and be on my way." Again, he said he'd like to go back to his car and get some information, and then he came back and told me I'd be getting a warning today, which I was quite honestly surprised by.

TL;DR: was subject to age profiling and an attempt to get me prison time, got away safely.

I remember when I lived in a state that had a front plate law it was considered a secondary offence (or something like that, I forget the legal term) meaning they couldn't pull you over just for that, If you were speeding or they had some other probable cause to pull you over they could then tag you for the plate.

Seems like a similar situation here, where the cop pulled you over and threw the front plate excuse out (knowing he couldn't legally stick just that charge alone on you) while hoping to find a true reason to have pulled you over.

Understood. Thanks for the clarification. It's strange that we feel compelled to make notice of our constitutional rights when they're trampled on with such great regularity.

You did right by showing the officer you knew your rights, but I'd be scared to do that same thing. I guess that's how a lot of police officers use subtle intimidation to get their way. It's really quite sad.

Sounds like you did everything exactly right. As a lawyer, the advice I always give to people about traffic stops is: (1) above all else, be polite to the cop, and (2) stick up for all of your rights, you have nothing whatsoever to gain by consenting to a search.

One of my favorite NV laws is the law on front plates essentially stating that a front plate is required only if there is a manufacturer installed front plate bracket. Neither my Audi or my Jeep came with a bracket (even though there is plenty of space and an available dealer installed option) so I haven't had to run a front plate.

I was once followed out of the town I used to live in by a state trooper (to which I responded with following the speed limit to a T) and was subsequently pulled over for "erratic driving". I did consent to a search and he also gave me a field sobriety test (stone sober and not on any type of legal or illegal medication). I passed the test, and the search. The guy called for backup and left me outside in the cold, handcuffed on the side of the road. I was 19 at the time and about 160 lbs (6' tall) so I'm not terribly intimidating at this point. I was on my best behavior for the whole time, and also freaking the fuck out on the inside. Once the backup got there he gave the initial officer a funny look and removed the handcuffs and apologized to me. He then walked over to the officer and told him he needed to let me leave since the first guy decided to go though my car for a second time. I was in the freezing cold for over and hour handcuffed for doing nothing but being 19.. Some of these guys are scary with all the power they have over normal people.

Front plates are required where I live but I don't run them. The Audi because it's too nice to ruin the lines with a front plate. The 1991 minivan because I'm too lazy to dig up a front plate and besides I've never been stopped or hassled for not having it. Because I'm not black! O.K. a little off topic, but you started it. About 10 years ago, I was on I-35South heading to Austin from OKC just past Hillsboro and as usual there's traffic and some construction. Some idiot in front of me in a pickup is doing 50MPH in the left lane for 30 miles. I tried everything from flashing my lights to honking my horn, to pulling beside him on the right and waving to get him to let me by. In the end, I finally passed him with little to no room to spare and resumed my 70MPH usual speed. About 5 minutes after I pulled into Waco to gas up, an old scruffy white guy pulls up to my bumper at the gas pump (it was the guy that wouldn't let me pass), jumps out of his truck and proceeds to cuss me out. Somewhere in there he states he's a County Police and has the right to arrest me. (Here's where we tie it all back in to your post and the OP).

I looked around me and there were all these young black college kids on their way back to school and all were watching this happen. Keeping this car related - I was in my 500SL with the top down and I'm a 40+years old black man. If I had let this continue, I felt it would have deleterious effects on their self-worth. So I stood up straight and tall as a career Air Force Officer would, held out my hands palms up and open, used my Command voice and told him, "You can arrest me now, or you can shut the F#$% up and walk away; anything else and I will call the local police myself and file assault charges." He was dumbfounded, stood there silent for what seemed like a minute, and everyone in the gas station went silent, too. As he turned and walked away, the crowd roared (I never noticed the crowd forming and it took all the remaining strength within me to maintain my composure); I nonchalantly finished pumping my gas and went on my way with my head and my heart 10 times their normal size ;).

Sounds like Ohio... Although I don't get pulled over for missing plates. None of my cars have front plates. The Subie is too new to justify it, the Seven has nowhere to put one, and the other Subie... well, I just have an issue with mandatory front plates. I think I've been chewed out for not having front plates twice, maybe. Neither time have I been ticketed for it.

Now, I have had been handcuffed and had the car searched before, without my permission, but that's another story...

I didn't run a front plate on my Cherokee Sport (96, 4.0, AX5!) for the longest time because no front plate bracket and perfect bumper. After a friend got a fixit ticket for $95 for the same offence I just ziptied the second plate to the bumper.

My GTI has a tow hook-mounted plate bracket, but a lot of the other GTI/Golf R guys I work with don't have a front plate. It ruins the lines of the car.

Wow, what an asshole. What kind of clue did he have to assume you must have been carrying something illegal, or going to, I dunno, kill someone?

Would it be possible to sue for damage if they get to search and screw up the interior?

Got pulled over so many times on that road it's not even funny. At least 15 times in 4 years. Never once got a ticket. Young and driving a loud coupe just makes you a target.

The cops never asked for a search. Multiple times they said they pulled me over for 'weaving within a lane' which I suppose was a catch all to get you pulled over. I don't think they're looking to arrest folks, it's just a revenue generation scheme.

My car is really clean and organized on the interior, and I don't smoke inside my car, so there really wasn't anything for him to base his assumption off of.

I'm not sure if you're able to sue for damages, I'd have to ask a lawyer.

Mine's the same way, it almost has that new car smell, even after 18 years in the family... And I usually don't carry anything at all, aside from a logbook, university ID card, car papers, and a few CDs, so there's nothing to look for here.

I don't have a current interior shot of my car since I replaced my head unit. I'll have to take one tonight. Very clean looking car though, looks great.

I saw this yesterday. Looks like you handled it correctly.

I'll admit that I'm not as well-acquainted with my rights as I should be for situations like this, but I think I have heard about cops twisting refusal to a search into probable cause. I'm glad you were let go in this case, though.

In (I think) 2002 I got stopped for no front plate on my '99 Dakota. The fine gentleman from the Ohio State Highway Patrol took that opportunity to ticket me for not wearing my seat belt (whatever...I deserved that), but at least waived the no-front-plate ticket. I had purchased the truck like a week earlier and there was no front plate bracket. I figured not having that front plate would attract unwanted attention in the future, so I badgered the dealer I bought the truck from into putting the front plate bracket on. I certainly don't blame anyone for not wanting to ruin the lines of their car....but it's hard to make a '99 Dakota look measurably worse with a license plate bracket.

Right to refusal of search is constitutionally guaranteed, fortunately. So if you just happened to have contraband that was seized due to a search that was only justified through a refusal as probable cause, that evidence would be forfeited in court.

I see, thanks. I wouldn't ever expect to be in a situation where I have contraband in my car, but this is a hassle anyhow.
